The training plans, coaching, drills, and guidance provided by Kathy Butler ("Kathy Butler Coaching," "we," "us") are for general fitness and educational purposes only. They are not medical advice, diagnosis, or treatment, and are not a substitute for consultation with a qualified physician or other healthcare professional.
Always consult your doctor before starting any new exercise program, especially if you have an existing injury, a medical condition, are pregnant, or are returning from a period of inactivity. Stop exercising immediately and seek medical attention if you experience pain, dizziness, chest discomfort, shortness of breath, or any other concerning symptom.
Running and endurance training carry inherent risks, including but not limited to muscle strain, joint injury, overuse injury, cardiovascular events, dehydration, heat illness, falls, and, in rare cases, serious injury or death. By participating in any coaching plan, group training session, or in-person session, you voluntarily assume all such risks.
In-person coaching and group training (including Run Boulder AC sessions) take place outdoors on roads, trails, tracks, and other terrain, and carry additional risks from weather, traffic, uneven or slippery surfaces, wildlife, and the presence of other participants or members of the public. You're responsible for using appropriate judgment, footwear, and equipment for the conditions.
You're responsible for accurately disclosing any injuries, medical conditions, medications, or physical limitations that could affect your ability to safely train. Training plans are built on the information you provide — Kathy Butler Coaching isn't responsible for outcomes resulting from incomplete or inaccurate health information.
Online coaching plans are delivered remotely — Kathy is not physically present while you train and cannot monitor your form, environment, or condition in real time. You're responsible for exercising in a safe location, at a safe intensity, and for stopping if something feels wrong. Training plans are adjusted based on the feedback you provide; delayed or inaccurate feedback may result in a plan that doesn't reflect your current condition.
While Kathy draws on over 20 years of professional athletics and coaching experience, no specific outcome — including race times, qualification standards, injury prevention, or fitness improvements — is guaranteed. Results depend on many factors outside our control, including your effort, consistency, health, genetics, and external circumstances.
Coaching plans are delivered through Final Surge and may sync with third-party devices such as Garmin, Apple Watch, or Wahoo. Payments are processed by Stripe. We aren't responsible for the availability, accuracy, or security of these third-party services, or for data loss, sync errors, or downtime originating from them.
Coaching services are intended for adults 18 years or older. If a minor participates in coaching, group training, or drills, a parent or legal guardian must review and accept this disclaimer on the minor's behalf, and takes full responsibility for the minor's safety and participation.
To the fullest extent permitted by law, Kathy Butler Coaching, and Kathy Butler personally, won't be liable for any injury, death, loss, or damage arising from or related to your participation in coaching, group training, drills, or use of any training plan, whether based on negligence or otherwise — except to the extent caused by gross negligence or willful misconduct. Some jurisdictions don't allow certain liability limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Kathy Butler Coaching from any claim, liability, or expense (including reasonable attorney's fees) arising from your own negligence, misuse of a training plan, or violation of this disclaimer.
This disclaimer is governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles. Any dispute arising from these terms will be resolved in the state or federal courts located in Colorado.
If any part of this disclaimer is found unenforceable, the remaining provisions will stay in full effect.
We may update this disclaimer from time to time. The effective date at the top of this page reflects the most recent revision. Continuing to use our coaching services after an update means you accept the revised terms.
By purchasing a coaching plan, joining a group training session, attending an in-person session, or otherwise using Kathy Butler Coaching's services, you acknowledge that you've read, understood, and agree to this disclaimer.
